A Supreme Court justice nominee’s refusal to answer a simple question speaks volumes about the state of sexual politics in America.

Consider the absurd irony of a situation in which a prospective justice of the U.S. Supreme Court – nominated for the job based on her gender (and race) – tells one of her Senate interlocutors at her confirmation hearing that she cannot provide a definition of the word “woman.”

The remarkable exchange occurred on March 22 when Ketanji Brown Jackson, a D.C. Circuit Court of Appeals judge, was asked by Sen. Marsha Blackburn (R-Tenn.), “Can you provide a definition for the word ‘woman’?”

After a short back-and-forth, the judge answered, “No, I can’t.”

“You can’t?” Blackburn asked.

“Not in this context,” Jackson said. “I’m not a biologist.”

The context of Jackson’ non-answer had nothing to do with her not being a credentialed expert in the branch of science concerning living organisms. In fact, her hesitancy to answer the question is the result of the outsized political power wielded by the transgender movement that abhors the obvious reality of sexual dimorphism in human beings. 

Jackson, a graduate of Harvard Law School, could have provided just the basic dictionary definition of “woman” – an adult female human being – while avoiding the drawn-out exchange Blackburn clearly wanted for the purpose of scoring cheap political points.

But proffering even that minimalist answer, of course, would be to risk incurring the wrath of those members of the transgender movement who believe being a woman is merely a matter of self-identification untethered from biology.

Jackson’s refusal to answer the question, however, portends something much more sinister. It is a sign the transgender lobby has succeeded in assigning moral and sociological implications to mere biological facts, which it then uses to demonize people with the temerity to point out obvious internal contradictions and logical inconsistencies when it comes to progressive transgender politics.

This feelings-over-facts approach – accepted by enough people in power to make a likely Supreme Court justice think better of answering a simple question – is what allows the more extremist members of the transgender movement, without fear of being laughed out of polite society, to deny the reality that women are physically and psychologically distinct from men.

Furthermore, the compliance of the political class as such also explains how some folks now unashamedly and, in all seriousness, advance the notion that biological genders are completely subjective and impossible to objectively define, while objectively recognizing transitions between them.

But back to Jackson’s non-answer. Unintentionally or not, she gave the impression that a “woman” in the biological sense is merely a social construct – that is, an illusion held up in society by politically charged cultural forces, rather than an objective reality that can be observed independently by any intelligent person regardless of moral values or acculturation.

The logical conclusion of Jackson’s de facto support of shifting definitions of gender from objective characteristics to inherently subjective and personal ones is that the category of “woman” – and by extension, “man” – effectively becomes meaningless.
