Antifa, Black Lives Matter & Democratic Party Could Owe Americans Reparations

While mayors and governors declared George Floyd protests to be "peaceful protests," insurance companies might seek to have them classified as an "insurrection" to avoid payment. So who would pay for the damage to American businesses? Rioters, looters and organizations which supported them may be liable, according to a $7 million judgement in the 1987 case of Donald v. United Klans of America.

U.S. Marshals Service Director Donald Washington toured Portland, Oregon's Mark O. Hatfield U.S. Courthouse on July 28 to examine damage from almost two months of violent protests by Antifa and Black Lives Matter following the death of George Floyd.

Since the nationwide protests began in May in Minneapolis, some 200 cities in 30 states have been affected. At least 14,000 people have been arrested in American cities including Washington, D.C., Boston, New York, Philadelphia, Chicago, Atlanta, Los Angeles, Portland and Seattle. 17 people have been reported killed, and hundreds injured. Crime has since skyrocketed nationally.

In what a Washington Post headline called "a night of destruction," federal monuments were defaced, memorial statues threatened with destruction by the mob, and Washington's historic St. John's Church ("The Church of Presidents") set on fire.

Statues of Washington, Jefferson, Lincoln, Columbus and even Frederick Douglass were toppled around the nation.

Michael Tracey pointed out on Medium.com that smaller cities were not spared. Among them: Atlantic City, NJ, Fort Wayne, IN, Green Bay, WI and Olympia, WA, where many destroyed business were owned by minorities and immigrants.

Yet when Washington Times columnist Robert Knight tried to find the total cost of damages, which he estimated in the "billions," he couldn't.

Knight explained: "I've searched in vain for news about the riots' overall cost. The media seem profoundly incurious. How many people have been killed? How many police officers have been injured or died? How many businesses have been destroyed? How much will it cost to fix everything that’s been broken?"

And who will eventually pay for this orgy of destruction?

We know President Trump said he wouldn't allow the federal government to do so

Which means private insurance companies may be asked to make up the difference.

As Peter Miller, a writer and artist living in Kamakura, Japan explained to me, "usual policy exclusions are 'earthquake, insurrection, or act of God.'"

While mayors and governors declared have them "peaceful protests," it's possible insurance companies could seek to reclassify them as an "insurrection" to avoid paying billions in compensation.

That would mean years of costly litigation, as cases wended their way towards the Supreme Court for final resolution.

However, there is an alternative -- victims of violence and property damage could file civil suits against rioters, looters and organizations which supported them, following precedent of a $7 million 1987 judgement in Donald v. United Klans of America.

Black Lives Matter received billions in corporate donations since the George Floyd protests began, which means they now have the kind of "deep pockets" lawyers find attractive. Antifa has received millions from non-profit organizations and private donors.

As the SPLC noted: "The verdict marked the end of the United Klans, the same group that had beaten the Freedom Riders in 1961, murdered civil rights worker Viola Liuzzo in 1965, and bombed Birmingham's 16th Street Baptist Church in 1963."

A similar legal strategy might obtain reparations for damages from Antifa, Black Lives Matter and perhaps even the Democratic Party.
